PROPOSED MARINA RULES CHANGES — 2022

Current Rule:
8.4. No improvements, repairs, or modifications to slips or docks are permitted without the express written consent of the HSIA Board of Directors. Dock boxes meeting all requirements outlined in Addendum A may be installed with prior written approval of the Chairperson of the Piers and Harbors Committee.
New Rule:
8.4.1 No improvements, repairs, or modifications to slips or docks are permitted without the express written consent of the Chairperson of the Piers and Harbor Committee.
8.4.2 The preferred method of mooring boats in the Marina is by securing mooring lines around pilings of the slip, dock or bulkhead.
8.4.3 Unless expressly approved in writing by the Chairperson of the P&H Committee:
a) Slip holders shall not install cleats, eye bolts, rings, blocks and pulleys, hooks, nails, handles, grab bars or other hardware on pilings, dock boards, joists, stringers, or bulkheads.
b) Slip holders shall not install dock bumpers, edging, guards or wheels on pilings, dock boards, joists, stringers, or bulkheads.
8.4.4 Slips holders may install line hangers designed for marine use on outer pilings provided they are parallel to the length of the slip, do not intersect the plane of the slip (i.e., do not project into the slip area), and are installed with stainless steel screws or lag bolts.
8.4.5 Dock boxes meeting all requirements outlined in Addendum A may be installed with prior written approval of the Chairperson of the Piers and Harbor Committee.

8.16.1 Crab Pots Prohibited. While crabbing is allowed from the Marina and Boat Ramp docks and piers, State law limits the use of crab pots to two (2) per property, which must be registered with the Department of Natural Resources (DNR) by the property owner (HSIA).
8.16.2 Crab pots may not be used at the Marina or Boat Ramp docks and piers by slip holders, Hillsmere residents, guests, or visitors.
8.16.3 Any crab pots found to be in use at the Marina or Boat Ramp docks and piers are subject to removal and disposal without notice.

7.1. HSIA may terminate or refuse to renew a Slip Permit for any of the following:
a) Boat not maintained in a safe, operable, and seaworthy condition.
b) Boat neglected by owner as evidenced by broken lines, improperly adjusted lines, repeatedly taking on water, excessive fouling or plant growth, causing damage to docks, or any other neglect as determined by Chairperson of Piers & Harbors.
c) Boat causing pollution by the discharge of oil or oily waste in the marina, or otherwise violating the federal or Maryland Clean Water Acts.
d) Slips that do not have the assigned boat present for long periods of time unless other arrangements have been made with the Chairperson of Piers & Harbors.
7.3. Any decision to terminate or not renew a Slip Permit under section 7.1 will be reviewed by the HSIA Board of Directors on request. Slip holders will be given 30 days notice of such an action and may, at the reasonable discretion of the Chairperson of Piers & Harbors, be allowed to correct the violations to avoid termination of the Slip Permit.

7.1. HSIA may terminate or refuse to renew a Slip Permit for any of the following:

c) Boat not used for one or more seasons, without extenuating circumstances.
d) Slips that do not have the assigned boat present for 30 days or more unless other arrangements have been made with the Chairperson of Piers & Harbor Committee.
e) Boat causing pollution by the discharge of oil or oily waste in the marina, or otherwise violating the federal or Maryland Clean Water Acts.
7.3.1 Slip holders shall be given 30 days notice in writing or by email of any proposed termination or refusal to renew a Slip Permit under Section 7.1 and the reasons therefor, and shall have an opportunity to meet with the Chairperson of the P&H Committee to discuss the proposed action.
7.3.2 At the discretion of the Chairperson of Piers & Harbor Committee, a slip holder may be allowed a reasonable period of time to correct any violations and avoid termination or non-renewal of the Slip Permit.
7.3.3 A slip holder may request that any decision to terminate or not renew a Slip Permit under Section 7.1 be reviewed by the HSIA Board of Directors.
